Terms of Service for Astro-COLIBRI

Welcome to Astro-COLIBRI! These Terms of Service ("Terms") govern your access to and use of the Astro-COLIBRI Service ("Service"), including our website, mobile application, and API ("API"), provided by Astro-COLIBRI ("we," "us," or "our"). By accessing or using the Service, you agree to comply with these Terms. If you do not agree, you may not use the Service.
1. License and Acceptable Use
1.1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for non-commercial, educational, and research purposes in accordance with these Terms.
1.2. Prohibited Uses
You may not:
- Use the Service to develop paid or commercial services without prior written approval from us.
- Redistribute, resell, or otherwise exploit data or services obtained via the Service for financial gain.
- Access the Service in a manner that could disrupt or damage our services or infrastructure.
- Use the Service for any illegal, harmful, or fraudulent activities.
- Attempt to bypass or manipulate the subscription system or receipt validation.
2. API Access and Security
If you use our API, the following additional terms apply:
2.1. API Key
Access to the API requires registration and the use of an API key. You are responsible for maintaining the confidentiality of your API key and for all activities performed using it. Sharing your API key is strictly prohibited.
2.2. Rate Limiting
We may impose limits on API usage, including the number of requests you may make in a given time period. Exceeding these limits may result in suspension or termination of your access.
2.3. Monitoring
We reserve the right to monitor API usage to ensure compliance with these Terms. Misuse may result in suspension or permanent revocation of access.
3. Subscriptions and Payments
3.1. Billing
Payments for the Astro-COLIBRI AR mode subscription can be made through the following channels:
- Apple App Store — purchases made on iOS or macOS are subject to Apple's terms and conditions.
- Google Play Store — purchases made on Android are subject to Google's terms and conditions.
- Web (RevenueCat Billing / Stripe) — subscriptions purchased directly through our web interface are processed by RevenueCat using Stripe as the payment processor and are subject to RevenueCat's and Stripe's respective terms. We do not store payment card details.
The subscription price is identical across all platforms.
3.2. Auto-Renewal
Subscriptions automatically renew unless canceled before the end of the current billing period. For App Store and Google Play subscriptions, cancellation must occur at least 24 hours before the period ends. Web subscriptions can be canceled at any time through the subscription management section of your Astro-COLIBRI account.
3.3. Refunds
Refund eligibility and handling depend on the platform through which the subscription was purchased:
- App Store purchases: contact Apple Support or request a refund via reportaproblem.apple.com.
- Google Play purchases: contact Google Play Support or request a refund through the Play Store.
- Web purchases: contact us at astro.colibri@gmail.com. Refund requests will be assessed and processed through RevenueCat/Stripe where applicable.
4. Data Usage and Ownership
4.1. Ownership
All data and intellectual property accessed via the Service remain the exclusive property of Astro-COLIBRI. These Terms do not grant you ownership of any content or intellectual property rights.
4.2. Permitted Use of Data
You may use data retrieved via the Service solely for non-commercial, educational, or research purposes unless expressly permitted otherwise.
4.3. Restrictions
You may not:
- Modify or obscure data to misrepresent its source.
- Use the data to train machine learning models for commercial purposes.
5. Termination
We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including but not limited to violation of these Terms. Upon termination, you must immediately cease all use of the Service and delete any data retrieved via the Service.
6. Disclaimer of Warranties and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
6.2. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
7. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.
8. Modifications to Terms
We may update these Terms from time to time. Continued use of the Service after changes are made constitutes acceptance of the revised Terms. The latest version of the Terms will always be available on our website.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of France. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts located in Paris/France.
